If you should have an accident that you believe to be someone else's fault then you may be able to sue the company or individual responsible and should take measures to try and improve your chances of being successful in court. First of all you should of course get to safety and if necessary call the emergency services to ensure you can get the medical attention you need. However if you're in a fit condition to do so while you wait, or if you have friends with you who can help, then there are certain checks you can make and precautions you can take to make sure you have all the information to take them to court if necessary.
First of all find out if there's CCTV in the area. If there is speak to someone who's in charge and ensure that they keep the footage and make a note that you've contacted them in person to request that they do (a lack of evidence in this case could be as damning as evidence in your favour). If you don't have time to do this immediately, or need to get help or medical attention pressingly, then you can always call up the owners of the land and ask them when you get home – chances are they'll keep the footage from cameras for at least a month before erasing it.
Similarly you should also ask witnesses if they saw the accident and if they'd be willing to support your claim if necessary. If so you should exchange contact details with them and inform them you will be contacting them soon.
Next if you have time you should check the area that you had the accident in. The reason you need to do this as soon after the accident as possible is that the owners of the land might otherwise try to change or clean up the area and repair any hazards that were there at the time. Look for things such as slippery floors – if it's slippery is there a sign to say so? Are there sharp edged? Was it a case of neglect that lead to the accident? If you fell through a window that's a ground level was it made from safety glass? If not this is a breach of health and safety too.
It can be a good idea too to write down everything that happened as soon as possible. If you are not in a condition to do so then you should dictate to a friend or use a computer or type writer. This way you will be able to get the details down on paper before you forget exactly what happened – if it was a nasty accident and you're in shock then there's a fairly high chance that you could otherwise not fully remember the details and it's the crucial details that could mean the difference between success and failure in court. You should also contact a lawyer as soon as is possible after an accident as they might want to chase up such things while the case is fresh – checking out the area and collecting information etc. Additionally the more time they have to collect information the more thorough your case will be.
